Provision of temporary and occasional ski instructor services in South Tyrol

Occasional and temporary work as a snow sports instructor (alpine skiing, cross-country skiing, snowboarding; hereinafter referred to as “skiing instructor”) is permitted for a maximum of 50 (fifty) non-consecutive days per year in the following cases:

Ø  Skiing instructors with a Euro-Test/Euro-Security-Test certificate:

·     may work as self-employed instructors in Italy;

·     must have a valid VAT number in their country of origin;

·     do not need to submit a separate notification in Italy.

 

Ø  Skiing instructors without a Euro-Test/Euro-Security-Test certificate:

may only work as self-employed instructors in Italy if they have submitted the following required notifications:

 

a) notification of the Autonomous Province of Bolzano/Bozen-South Tyrol*

·         The official form available at https://civis.bz.it/seca-resource?id=1080624&serviceID=1032724&lang=de must be filled in

·         and submitted to tourismus@provinz.bz.it or turismo@provincia.bz.it.

 

b) notification of the employer (ski school) in South Tyrol**

·         The official form available at https://civis.bz.it/seca-resource?id=1080624&serviceID=1032724&lang=de must be filled in and submitted as described above together with:

·     a signed contract of cooperation

·     proof that the applicable financial compensation (EUR 25.00 plus VAT per day and skiing instructor) has been paid to the ski school in question citing the following bank transfer reference: "Verwaltungsaufwand Meldung/Überwachung ausländischer Skilehrer – [name of tour operator]

 

 

 

General information for tour operators

a)    Terms defined by the authorities

A preliminary notification of the provincial authority (Autonomous Province of Bolzano/Bozen-South Tyrol, Area funzionale Turismo/Funktionsbereich Tourismus) does not grant formal authorisation.

Applicants may start working as soon as the notification has been submitted, on the condition that their documents comply with the legal requirements and that all required documents have been submitted in full. If the documents are incomplete and/or the provincial authority determines that the legal requirements have not been met (in this case, feedback must be provided within 30 days) and the applicant is found to have started working nevertheless, they may – subject to further provisions – face prosecution for unlawfully practising the profession of skiing instructor pursuant to Art. 348 of the Italian Criminal Code and an administrative penalty pursuant to Art. 20 of Legge provinciale/Landesgesetz 5/2001 totalling between EUR 516.00 and EUR 2,582.00.

 

b)    Notification of the ski school

The ski school in question should be given sufficient opportunity to check that all required documents are complete. We therefore recommend sending the documents to the ski school by email well in advance of the first day of work.

 

c)    Cooperation with ski schools

Draft contracts for cooperation with ski schools are not employment contracts.

It is a prerequisite that the skiing instructors are employed by a ski school abroad or by the tour operator.

The tour operator shall indemnify the ski school and/or their director against any unlawful conduct by the instructor as well as against any third-party claims (e.g. social security institutions).

All deployed skiing instructors must strictly adhere to the professional standards of the South Tyrol Chamber of Skiing Instructors.

South Tyrolean ski schools can only refuse cooperation if the required documents (as described above) have not been submitted.

The notification of the provincial authority and of the ski school should be submitted at the same time.

If the skiing instructor’s liability insurance does not provide the required cover (EUR 6,000,000), the ski school can co-insure the skiing instructor upon request.

Cooperation agreements between ski schools and foreign skiing instructors do not count towards the quota of ski school assistants.

* Notifications are only valid for the year in which they were made. Accompanying persons are not subject to the scope of the legal provisions of Legge provinciale/Landesgesetz 5/2001.
